Warranty conditions

1. Definitions 

For the purposes of this Warranty Policy, the following terms shall have the meanings set out below: 
“SiFly AI Ltd.” (“SiFly”) refers to SiFly AI Ltd., including its affiliated entities such as SiFly USA Inc., Sifly ME FZC,  as well as any authorized SiFly reseller or distributor. 
“Product” means any SiFly-branded eFoil, board, hydrofoil unit, battery, accessories, or related components produced or supplied by SiFly and subsequently sold by an authorized reseller. 
“User” means any individual or legal entity who has purchased or is in lawful possession of the Product, including both original and subsequent owners, provided that the original proof of purchase (invoice) is available. 

2. Introduction 

SiFly AI Ltd. or any authorized reseller warrants that the products sold are free from manufacturing defects and damages for the coverage period stated below.  
To file a claim, you should fill in the online warranty claim form or contact our support team at support@sifly.global.  

SiFly may request pictures, videos, or any other files that would help process the warranty claim, as well as request to connect the device to a WiFi network for remote diagnostics. SiFly reserves the right to inspect the Product, including requiring it to be sent to an authorized service center, before approving any warranty claim. You must present the original invoice for the purchase of the product. SiFly will cover the reasonable costs for shipping a defective product to and from the nearest service center. If, after evaluation of the claim, a fault is found due to misuse, SiFly will ask you to pay the shipping cost to and from the service center, as well as the repair costs, if they are accepted.  

You can make a warranty claim if you are the original or secondary owner of the product. The warranty is transferable. Even if you are not the original owner and have not purchased directly from us or from an authorized SiFly reseller, you are entitled to make use of the SiFly warranty if you are in possession of the original invoice for the purchase. 

3. Warranty Coverage Period 

3.1 Within EU and North America: 

The warranty of the SiFly board is valid for 2 years in case of a manufacturing defect.

 The warranty of the SiFly battery is valid for 2 years or 300 battery cycles – whichever event occurs first.  

The warranty of the SiFly hydrofoil is valid for 2 years or 300 motor operating hours– whichever event occurs first. There is a mandatory hydrofoil service interval of every 100 motor operating hours or 12 months – whichever event occurs first. The warranty of hydrofoils that have not been serviced within the required interval is VOID. Servicing can be performed at the nearest SiFly service point. 

 The wings, remote controller, and charger are warranted for a period of 2 years. 

3.2 Rest of the World: 

The warranty of the SiFly board is valid for 1 year in case of a manufacturing defect.

The warranty of the SiFly battery is valid for 1 year or 300 battery cycles – whichever event occurs first. 

The warranty of the SiFly hydrofoil is valid for 1 year or 300 hours of motor operating hours– whichever event occurs first. There is a mandatory hydrofoil service interval of every 100 motor operating hours or 12 months – whichever event occurs first. The warranty of hydrofoils that have not been serviced within the required interval is VOID. Servicing can be performed at the nearest SiFly service point.  

The wings, remote controller, and charger are warranted for the period of 1 year.

Note: A battery cycle involves consecutive or multiple partial discharges of a total of 100% capacity. 

4. Warranty Coverage 

SiFly AI Ltd. covers manufacturing defects of all products. A ‘manufacturing defect’ means a defect in materials or workmanship under normal use in accordance with the User Manual. 

NOT Covered by the SiFly Warranty Policy 

The following events are not covered by the warranty: 

•    Damage caused by normal wear and tear. 
•    Punctures and/or self-repaired damage to the board. 
•    Damage or defects caused by transportation, loading, unloading, dropping, or out of water handling. 
•    Damage or deterioration of the paint and clear coat of composite hard boards due to improper storage conditions, including storage of the board in closed, damp conditions (for example, wet in board bag). 
•    Damage or defects caused by improper mounting or adjustment of bindings or foot straps. 
•    Damage due to excessive heat exposure (over 50 °C / 120 °F), including direct sunlight or extended amount of time left in a car on a hot day. 
•    Damage due to improper care, usage, storage, or operation in unsafe locations, and/or use in any other unsafe conditions not in accordance with the user manual. 
•    Damage due to abuse, misuse, accidents, or collisions of the eFoil against hard objects or in shallow waters. 
•    Damages due to climbing on and off the eFoil while it is not floating and is sitting on the bottom in shallow waters or on solid ground. 
•    Damage due to failure to properly maintain the SiFly eFoil and its components in accordance with the instructions found within the User Manual. 
•    Damages due to disassembling the motor, ESC, board controller units, the remote controller, charger, or battery. 
•    Damages due to unauthorized modifications in the eFoil or use of third-party components, including, but not limited to, modification of its internal circuitry, components, battery, battery cells, connectors, connector cables, etc. 
•    Damages due to unauthorized repairs and maintenance. 
•    Damage or defects caused by usage of the SiFly eFoil after a warranty issue is reported, or when a customer should have reasonably made a warranty claim. 
•    Personal injury or death, property damage, or financial loss, however caused. 
•    Damage caused by anything other than manufacturing defects. 
•    Damage caused by failure to install a critical firmware update, when prompted to do so by the mobile app, and using the product. 
•    Damage in the battery casing or internal components due to sustained physical impact, drop, or puncture. 
•    Damage to the battery resulting from deep discharge of the battery cells due to prolonged storage at low or depleted charge levels is not covered. Users are required to check the battery’s state of charge and voltage at least once per month and maintain it within a recommended range of 30%–70% during storage 
•    Exposure to abnormal conditions, including prolonged storage at temperatures beyond the recommended range. 
•    Usage of unauthorized third-party parts and modifications, including third-party chargers, connectors, and connector cables. 
•    Usage of the battery for unauthorized purposes and with unauthorized devices. 
•    Unauthorized disassembly of the battery. 
•    Ingression of water in the battery compartment when within normal operating conditions, does not constitute a defect and is not grounds for a warranty claim. 

Firmware updates may be classified as critical or recommended. Critical updates must be installed when made available. Failure to install a critical update may result in limited functionality or damage and may affect warranty coverage where such failure contributes to the issue.

This warranty is provided in addition to, and does not affect, any statutory rights granted to consumers under applicable consumer protection laws. 

5. 14-Day Free Return Policy 

If you have purchased a SiFly product in the EU for non-commercial use, you have the right to return it within 14 days of delivery, provided that the product is in the original package and is in near perfect condition as expected. The shipping costs are covered by the customer. SiFly will reimburse the purchase within 30 days. 

6. How Will SiFly Honor Your Warranty? 

When a warranty claim for a defective part is accepted, SiFly will take one of the following actions within 60 days:

  1. Send you a replacement part
  2. Repair the defective part or
  3. Pay for the cost of repairing the part or supplying the replacement part by the customer. 

7. Service Regions and Logistics 

Warranty service is available within designated service regions where SiFly or its authorized partners operate service centers, including Continental Europe, the United Kingdom, Continental North America, the United Arab Emirates. SiFly will cover reasonable shipping costs to and from the nearest authorized service center within these regions. 

For Products located outside these designated service regions, the User is responsible for organizing and covering the transportation of the Product to and from the nearest authorized service center. SiFly may assist with coordination but shall not be responsible for additional logistics, transportation, or handling costs beyond standard shipping within the designated service regions. 

If the Product is located outside a designated service region, the User shall be responsible for organizing and covering the transportation of the Product to the applicable service location. 

The determination of the nearest authorized service center and applicable service location shall be made at SiFly’s reasonable discretion. 

Warranty service is guaranteed in the country of original purchase. If the Product is relocated to another country or region, SiFly may, at its sole discretion, assist in arranging service at the nearest authorized service center within the designated service regions; however, such assistance is not guaranteed and shall not constitute an obligation to provide warranty service outside the country of original purchase. 

Any customs duties, VAT, import taxes, or similar charges arising in connection with the import and receipt of shipment of the Product shall be borne by the User. 

7. Governing Law 

This Warranty Policy shall be governed by and construed in accordance with the laws of the country in which the Product was originally purchased from SiFly or an authorized reseller. 

For Products purchased directly from SiFly AI Ltd., Bulgarian law shall apply. 

For Products purchased from SiFly USA Inc., the laws of the State of Florida, USA, shall apply. 

For Products purchased from authorized resellers, the applicable law shall be the law of the country where the reseller is established, unless otherwise required by mandatory consumer protection laws. 

This provision does not affect any mandatory rights granted to consumers under applicable local laws. 
 
SiFly reserves the right to update this Warranty Policy at any time. The version applicable to the Product shall be the version in effect at the time of purchase.
